YORK, Pa. (AP) – Two former York County Prison guards accused of mistreating inmates by forcing them to fight or do demeaning stunts have been placed on probation for two years.
Thirty-year-old David Whitcomb Jr. and 40-year-old Daniel Graff were convicted by a York County jury last month of official oppression, criminal conspiracy and harassment.
Judge Richard Renn on Monday called the case unusual, saying the two had violated the public trust but adding that the charges they were convicted of were relatively minor.
Defense attorneys argued that other current or former inmates made up the allegations. Jurors acquitted a third ex-guard, 28-year-old Mark Haynes.
After sentencing, Whitcomb said only “We agree with the court’s decision.” Graff said the district attorney “did a great job” because she had “successfully prosecuted two innocent men.”
