HARRISBURG, Pa. (WHTM) – Pennsylvania’s fiscal watchdog says the state Department of Labor and Industry was “woefully unprepared” to enforce a law to protect healthcare workers from excessive mandatory overtime.
Auditor General Eugene DePasquale said an audit by his office found Labor and Industry didn’t adopt the regulations needed to enforce Act 102 of 2008 until July 2014, more than four years after the legislatively mandated deadline of April 1, 2010.
In addition, DePasquale said the department dismissed eight percent of the complaints it received during the audit from July 2009 to August 2014, and it had poor documentation for many others.
He said the law clearly was not a priority at the department.
Act 102 of 2008 limits hospitals, nursing homes and other healthcare facilities from requiring hourly, non-supervisory employees involved in direct patient healthcare to work more than agreed to, predetermined and regularly scheduled work shifts.
DePasquale said Labor and Industry agreed with the findings and recommendations made by his office.
