Law to end DUI loophole takes effect

HARRISBURG, Pa. (WHTM) – A new law will mean tougher penalties for drunk drivers arrested for repeat violations.

Act 189 of 2014, signed into law this fall, took effect Thursday.

The legislation allows prosecutors to charge drunk driving suspects as repeat offenders if they are re-arrested for DUI before they are convicted for the first offense.

The measure was introduced after the Pennsylvania Supreme Court ruled a driver arrested for drunk driving twice in the same night could only be charged as having committed a first offense because he hadn’t been yet convicted of the first charge.
