A class-action complaint for malpractice and negligence has been filed against a Harrisburg-area plastic surgeon who recently urged patients to get tested for serious infections including HIV and hepatitis.
The complaint against Dr. Mark S. Boland was filed Wednesday in Dauphin County court on behalf of a former patient.
In a letter dated July 21, Boland informed patients who underwent a minor surgical procedure at his Lower Paxton Township office that infection control procedures may have been insufficient to prevent possible contamination.
Boland told patients he was not aware of any instances where patients developed an infection, but he urged the laboratory blood testing as a precaution.
The former patient says Boland’s office refused to pay for any part of the testing, which caused her significant personal expense as well as significant inconvenience, mental stress and anxiety.
The complaint seeks money damages for all patients who incurred similar expenses.
