3 held for trial in home-invasion killing

Three men are headed to trial on charges they killed a Lancaster County man during a home invasion robbery in August.

Cody Wunder, 24, his brother Kyle, 22, both of Aston in Delaware County, and 26-year-old Stephen Harmer, of Kirkwood, all waived their preliminary hearings before a district judge Friday morning.

Each is charged with criminal homicide, robbery, burglary and criminal conspiracy for the August 17 killing of Douglas Herr.

Prosecutors have said the defendants went to Herr's home at 1297 Furniss Road in Drumore Township because Harmer knew the victim had a safe with about $200,000 in cash that he had received in a settlement from his wife's death in 2009.

After the three broke into the house by smashing the glass from a sliding door, investigators said the 62-year-old Herr retrieved a gun and used it to shoot Cody Wunder during a physical struggle in an upstairs hallway.

Moments later, Kyle Wunder shot Herr in the head with a shotgun, according to prosecutors.

The three are being held in Lancaster County Prison without bail. Formal arraignments in Lancaster County court are scheduled for November 28.
